What is the Data Act?
The Data Act gives you the right to access and port data generated through the use of our cloud services. The legislation is designed to make switching between different service providers easier and fairer by ensuring data accessibility.
How Provider Switching Works in Practice
If you wish to switch from Compello to another provider, we follow a structured and predictable process in line with the Data Act:
- Notice: You initiate the process by providing written notice according to the terms of your agreement. In this notice, you must specify which services and data you wish to transfer.
- Transitional Period: After the notice period, a 30-day transitional period begins. During this time, Compello will:
- Assist you and your new provider in the switching process.
- Ensure the stable and secure operation of your services.
- Facilitate a secure transfer of your exportable data.
- Note: If the process is technically complex, this period may be extended with a thorough justification.
- Your Responsibility: To ensure a smooth transition, you are responsible for receiving and implementing the data with your new provider. You must also provide Compello with the necessary information to assist effectively.
- Data Deletion: Once the transfer is complete and a short retrieval period has passed, Compello will ensure the secure and complete deletion of your data from our systems.
Which data can you take with you?
You have the right to take all "exportable data." This includes content you have entered yourself and relevant usage data.
Exemptions: Some data is exempt if it is crucial for the functionality of our services or contains trade secrets. We will always provide a transparent overview of which data can be transferred and which, if any, are exempt.
What does it cost?
There are two types of costs to be aware of:
- Switching Process Fee:
- Until January 12, 2027, Compello may charge a fee that covers only the direct costs related to the switching work.
- After January 12, 2027, the switching process will be free of charge.
- Ordinary Contractual Obligations:
- Switching providers does not change the financial obligations in your existing agreement.
- If you switch mid-contract, you remain obligated to pay for the remaining period as specified in your agreement.
Where is your data processed?
You can find a complete overview of where your data is processed (region and country) and by which suppliers on the Visma Trust Centre.
Public Authorities
Police and other authorities may demand the disclosure of information, including personal and non-personal data. In such cases, Compello follows strict internal procedures and consults with Visma’s legal department. We only share information strictly required by law and based on valid court orders.
To prevent unauthorized access, Compello implements technical measures such as encryption and access controls. Compello participates in the Visma Security Program (VASP), ensuring high security standards and confidentiality. If we receive access requests from authorities outside the EEA, we comply with Article 32 of the Data Regulation.
